Publicly recorded actions by the Jefferson County Commission years ago make it clear that a current road dispute has no validity, an attorney told the current commissioners May 9.
At issue is Rocky Road, a road that heads west from Highway 69 in the Boulder Valley and provides access to subdivided lands. That road was the subject of a lawsuit filed in 2008. The court subsequently found partly in favor of those seeking to close the road to the general public. Since that suit ended, a locked gate has been placed on the road, triggering a dispute between area landowners.
Cherche Prezeau, attorney for those who went to court to close the road to the general public, said the county was aware of the lawsuit in 2008 and chose not to intervene. “The commission knew we were fighting out this lawsuit,” said Prezeau. The planning board recommended denial of a subdivision proposed further up Rocky Road than the disputed area, but the commission chose to grant approval. In last week’s meeting, Prezeau provided copies of commission minutes in which Deputy County Planner Mike Hoffman told the commission that because of the ongoing road dispute, then-County Attorney Matt Johnson recommended the commission attach a statement to the final plat approval for the subdivision.
