Notice of Application and Protest Deadline For Temporary Operating Authority

1. On December 10, 2025, Allied Waste Services of North America, LLC dba Republic Services of Montana (“Republic”), submitted its finalized Application for Certificate of Public Convenience and Necessity (“Application”) with the Montana Public Service Commission (“Commission”). In its Application, Republic requests authority to transport garbage as a Class D motor carrier between all points and places in Jefferson County, Montana that are located within one mile of Highway 287 to a lawful disposal site.

2. On December 10, 2025, Republic also submitted its finalized Application for Intrastate Temporary Operating Authority (“TOA Application”). In its TOA Application, Republic requests temporary operating authority to transport garbage as a Class D motor carrier between all points and places in Jefferson County, Montana that are located within one mile of Highway 287 to a lawful disposal site.

3. A copy of the TOA Application is publicly available at the Commission’s business office, 1701 Prospect Avenue, Helena, MT 59601, and online at the Commission’s website (psc.mt.gov) under Docket No. 2025.12.087. A copy of the Application may also be available at the office of the Montana Consumer Counsel, which represents consumer interests before the Commission, 111 North Last Chance Gulch, Suite 1B, Helena, MT 59601, (406) 444-2771. Interested parties can register on the Commission’s website to receive notice of filings in this docket. Instructions for subscribing to notices of filings are available at psc.mt.gov/reddi-help.

4. Any interested party who can and will provide all or any part of Republic’s proposed service may protest the TOA Application. Mont. Admin. R. 38.3.505. Protests and requests for hearing must be filed with the Commission no later than January 22, 2026. The form titled “Protest to Application for PCN, S&T, or Lease” is available on the Commission’s website under the “Regulated Utilities” tab, then the “Compliance Materials and Forms” tab, and then the “Motor Carriers” box, under the subheading “Protests.” 

5. Protests must be submitted to the Commission both electronically and in hard copy. Protests must be submitted electronically to the Commission through REDDI at reddi.mt.gov. A hard copy must be delivered to the Commission’s business office listed above or mailed to the Commission at P.O. Box 202601, Helena, MT 59620. A filing fee of $500 must accompany the hard copy delivered or mailed to the Commission. A hard copy of each protest must also be mailed to Republic’s attorney, Lucas H. Forcella, Crowley Fleck PLLP, P.O. Box 2529, Billings, MT 59103. 

6. The Commission invites members of the public who do not wish to formally protest the TOA Application to submit written public comments on the matter to the Commission at P.O. Box 202601, Helena, MT 59620, or by email to pschelp@mt.gov. Public comments may also be submitted online in REDDI. Instructions for submitting public comments in REDDI are available at psc.mt.gov/reddi-help (select “Submit a Public Comment”). Personal or private information should not be included in comments.

7. The Commission’s jurisdiction over this matter is provided in Title 69 and Title 2, Chapter 4 of the Montana Code Annotated; Title 38, Chapters 2 and 3 of the Montana Administrative Rules; and any prior orders of the Commission relevant to the issues presented.
