To: The above-named Defendants. A lawsuit has been filed against you.
Within 21 days after service of this Summons on you, you must serve on the Plaintiffs an answer to the attached Complaint or a motion under Rule 12 of the Montana Rules of Civil Procedure. Do not include the day you were served in your calculation of time. The answer or motion must be served on the Plaintiff’s attorney, whose name and address are listed above.
If you fail to respond, judgment by default will be entered against you for the relief demanded in the Complaint.
You also must file your answer or motion with the Court.
This action is brought to petition to remove a deed restriction on land situated in Jefferson County, Montana, and described as follows:
Land located in the NW1/4 of Section 25, Township 2 North, Range 2 West, P.M.M., more particularly described as follows and referred to herein as “the Property”:
Beginning at the northwest corner of said Section 25, being coincident with the northwest corner of the parcel herein described, thence, First Course, North 89°27’58” East of 2080.02 feet on the north boundary line of said section 25 to the intersection point of the north boundary line of said Section 25 and the extension of a northwesterly right-of-way line of a Jefferson County road; thence Second Course, South 39°08’43” West 640.66 feet on said right-of-way line and extension to the point of curve of a curve to the right being concave northwesterly with a central angle of 31°31’57” and a radial line which bears North 50°51’17” West 696.14 feet from said point and a chord which bears south 54°54’42” West 378.30 feet; thence, Third Course, on said curve southwesterly 383.12 feet on said right-or-way to the point of tangency; thence Fourth Course, South 70°40’40” West 1445.49 feet on said right of way to the west boundary line of said Section 25; thence Fifth Course, North 00°05’30” West 1173.22 feet on said line to the point of beginning. SUBJECT TO building condition and restrictions as set forth in Book 123 of Deeds, page 222, records of said Jefferson County.
