The following cases were heard in district court in Boulder recently.
Brad Heath was found guilty of driving under the influence following a two-day jury trial before Judge John C. Brown June 29 and 30. Heath was arrested April 10 at around 1:15 a.m. when law enforcement officials say he was weaving on a motorcycle. Witnesses testified that his blood alcohol content was later tested at .212, close to three times the legal limit. During the trial the defense objected to the admission of a video, challenged the quality of the blood draw and complained about a witness being in the courtroom. The jury took less than two hours to reach a guilty verdict. Judge Brown ordered a pre-sentence investigation.
Julio Marco Lopez of Butte admitted violating the court conditions of his release while awaiting proceedings on charges of felony burglary and felony theft. Those charges arose from allegations he stole tools from an Elk Park residence on March 25, 2016. In court June 28, Lopez admitted he failed to maintain his employment, changed his address without permission and failed to comply with an order for GPS monitoring. His bail, previously set at $75,000, was revoked and he was remanded to the custody of the sheriff.
