A Stipulation and Settlement Agreement between Claimant Lockhart Meadows LLC and Objector Burnt Hollow Holdings, LLC, deemed by the Court to be a Motion to Amend Statement of Claim, has been filed with the Montana Water Court seeking to amend Statement of Claim 41E 94306-00. The Basin 41E Preliminary Decree for this claim states that both the period of diversion and period of use are from “JUNE 1 TO SEPTEMBER 30,” which Claimant proposes to amend to “APRIL 25 TO OCTOBER 5” to reflect the standardized dates for Climatic Area V pursuant to Rule 16(a), W.R.C.E.R.
